PREREQUISITE In order to protect our established custromers, we ask that you provide evidence that you are actively involved in the nursery business, that you have an established business location, and that you furnish us with a copy of your state tax exemption or business certificate papers so that we may keep it on file. TERMS Our regular provisions are C.O.D.  However, we do offer a discount based on the volume of the purchase.  Wholesale prices are intended for resale only and do not include freight charges and are subject to change without notice.  We now offer check by fax for your convenience. DISCOUNTS Our customers  may qualify for discounts either when picking up their orders or for large quantities delivered.  This excludes on-sale items. Discounts will be rebilled if funds are not received as agreed. BOOKINGS/AVAILABILITY Orders are accepted on condition that they may be voided or delayed without liability to seller due to delay or failure to deliver caused by crop failure, inclement weather, errors in count, or other causes beyond our control. All orders accepted are subject to availability of stock at time of delivery. All orders are subject to prices stated in price list current at the time of delivery.

MINIMUM QUANTITIES Our size minimums for each variety ordered are: #01 gallon - 10 per variety #03 gallon - 5 per variety all flats - sold as solid flats SUBSTITUTION OF SIZES We reserve the right to substitute the closest size and/or color available if size/color ordered is not available.  However in all changes we will attempt to keep you informed of availabilty. SHIPPING/DELIVERY It is the customer’s responsibility to unload plant materials.  Additional drop charges may apply for delivery to specific sites.  A restocking fee will be charged for cancelled orders once plants have been pulled for shipping, are in transit, or are refused with no due cause upon delivery. CREDIT POLICIES We generally require C.O.D. status for at least one calendar year.  We will be pleased to consider credit arrangements with established firms upon completion of approved credit application. CLAIMS We warrant our nursery stock to be true to description or variety under the name in which it is sold.  However, should a problem arise, we hold ourselves (in readiness), with proper proof, to replace such nursery stock.  We give no warranty, expressed or implied, as to the productiveness or longevity of the nursery stock we sell, nor will we be responsible for the results secured on transplanting.  We shall in no cause be liable for any sum greater than the amount originally received for said nursery stock, less shipping costs and applicable restocking fees.  We will not consider for any cause claims made after goods have been accepted with your signature on the invoice and/or bill of lading.
